Speakers: Richard McCormick, Immunolnnova IP Consulting, Zachary Silbersher, Silbersher Law, Ben Doranz, Ph.D., Integral Molecular and  Gene Quinn, IPWatchdog, Inc.

Examples of allowed by USPTO genus claims for antibodies based on common structural feature of the antibody’s paratope [antigen-binding site] and permissible substitutions across the CDRs would be discussed.

See Banik, S.S.R., Deng, X., Davidson, E. et al. Redefining antibody patent protection using paratope mapping and CDR-scanning. Nat Biotechnol43, 170–174 (14 Feb. 2025). Authors, Integral Molecular employees, proposed to use a mutational CDR scanning to identify  antibody’s antigen-binding site [paratope]. A genus antibody claim based on such scanning could be written as: “An antibody comprising a heavy chain variable region (HVR) and light chain variable region (LVR), wherein the HVR comprises an … HCDR3 comprising an amino acid sequence of X1PX2X3X4WX5, wherein X1 is an amino acid selected from F, I, L, Y, … ”.”

[In CRISP technology]  …there has been and continues to be a war over patent priority, that has been waged for over a decade by four separate groups of purported inventors, and at present there is no end in sight. In particular, Broad Institute, Harvard University, and the MIT (collectively, "Broad") and The Univ. of California/Berkeley, the Univ. of Vienna, and Emmanuelle Charpentier (collectively, "CVC"), are currently back before the PTAB after the Federal Circuit vacated an earlier decision in Broad’s favor in a second interference between them. The two other parties, ToolGen (a Korean company) and Sigma-Adrich each have separate pending interferences against Broad and CVC, with a possible further interferences between ToolGen and Sigma.

Panelists: Daniel Block, Director,  Sterne Kessler,  Austin Walters,  Founder & CEO,  IP Copilot,  and Gene Quinn,  President & CEO,  IPWatchdog, Inc.

Traditional workflows—such as prior art searching, claim analysis, and invalidity investigations—require attorneys to manually review large volumes of patents and technical publications. Modern AI systems can analyze thousands of documents simultaneously, surface relevant disclosures, and pinpoint evidence tied to specific claim elements. Instead of reviewing a small set of references, attorneys can now explore far larger datasets and test multiple search strategies in parallel. …we explore how AI-powered tools allow patent teams to conduct prior art analysis and litigation preparation at scale.
